These Terms and Conditions (“Terms”) govern your access to and use of the B5 Structures website (the “Site”) operated by B5 Structures (“B5 Structures,” “we,” “us,” or “our”). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

1. The Site Is Informational and for Lead Generation

The Site provides information about our metal building products and services and allows you to request a quote, submit project details, and use our design tools. The Site does not allow you to purchase products, make payments, or enter into a binding contract online. Any purchase is completed separately through a written agreement between you and B5 Structures.

2. Quotes, Estimates, and Designs Are Non-Binding

Any quote, estimate, price, drawing, or concept design generated through the Site or our tools is provided for general informational and planning purposes only. It is not an offer, guarantee, or binding commitment. Final pricing, specifications, materials, dimensions, structural engineering, and availability are confirmed only in a separate written contract. Pricing and product availability are subject to change without notice.

3. Interactive Design Tools

Our interactive design room, 3D building configurator, and similar tools are intended to help you visualize options and explore concepts. The outputs are approximations and do not represent final engineered designs, exact dimensions, exact colors, or final pricing. Final designs are subject to review, engineering, and confirmation by B5 Structures.

4. Financing

Any financing referenced on the Site is provided by independent third-party lenders, not by B5 Structures. All financing is subject to credit approval, lender terms, and lender eligibility requirements. B5 Structures is not a lender, does not make credit decisions, and does not guarantee that financing will be approved or available on any particular terms. Your financing relationship is solely between you and the third-party lender.

5. Installation

Installation of our buildings is performed by B5 Structures or its authorized installers only. Statements on the Site regarding installation refer to professional installation by B5 Structures or its authorized installers.

6. Warranties

Any warranties that apply to products purchased from B5 Structures are described in the separate written contract or documentation provided in connection with your purchase, and those documents control. Except as expressly stated in a signed agreement, the Site and its content are provided “as is” and “as available,” and we disclaim all warranties of any kind regarding the Site, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components, or that information on the Site is complete, accurate, or current.

7. Intellectual Property

The Site and its content, including text, graphics, logos, images, designs, and software, are owned by or licensed to B5 Structures and are protected by intellectual property laws. You may not copy, reproduce, modify, distribute, or create derivative works from any part of the Site without our prior written permission.

8. Acceptable Use

You agree not to use the Site to submit false or misleading information, to violate any law, to interfere with or disrupt the Site or its security, or to attempt unauthorized access to any system or data. We may suspend or restrict access to the Site at our discretion.

9. Third-Party Links

The Site may contain links to third-party websites and services, including financing partners. We do not control and are not responsible for the content, products, or practices of those third parties. Access to and use of any third-party site or service is at your own risk and subject to that third party’s terms.

10. Limitation of Liability

To the fullest extent permitted by law, B5 Structures and its owners, employees, and representatives will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, goodwill, or business, arising out of or related to your use of (or inability to use) the Site or any information on it, even if we have been advised of the possibility of such damages. To the fullest extent permitted by law, our total liability arising out of or related to the Site will not exceed one hundred U.S. dollars (US $100).

11. Indemnification

You agree to indemnify and hold harmless B5 Structures and its owners, employees, and representatives from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising out of your use of the Site or your violation of these Terms.

12. Governing Law

These Terms are governed by the laws of the State of Ohio, without regard to its conflict-of-laws rules. You agree that any dispute arising out of or relating to these Terms or the Site will be brought exclusively in the state or federal courts located in Ohio, and you consent to the jurisdiction of those courts.

13. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the Effective Date above. Your continued use of the Site after any change indicates your acceptance of the updated Terms.
